These Terms of Service (“Terms”) govern your access to and use of the Pour N Pack website and any orders placed through it. By placing an order or using this website, you agree to these Terms. If you are placing an order on behalf of a business, you confirm you have authority to bind that business to these Terms.
2.1 All orders placed via this website or otherwise in writing constitute an offer to purchase. We reserve the right to accept or decline any order at our discretion.
2.2 An order is confirmed only when we issue a written order confirmation or tax invoice.
2.3 We may impose minimum order quantities. Current minimums are displayed on the relevant product pages.
2.4 Pricing is quoted in Australian dollars (AUD) and is exclusive of GST unless stated otherwise.
3.1 Prices are subject to change without notice. The price applicable to your order is the price confirmed at the time of order acceptance.
3.2 Payment terms are net 14 days from invoice date unless otherwise agreed in writing.
3.3 We reserve the right to charge interest on overdue amounts at the rate of 2% per month, calculated daily from the due date.
3.4 We may suspend or cancel future orders if an account is overdue.
4.1 Delivery timeframes provided are estimates only. We are not liable for delays caused by carriers, customs, or circumstances outside our reasonable control.
4.2 Risk of loss or damage to products passes to you upon handover to the carrier.
4.3 Title to goods passes to you upon receipt of full payment.
4.4 You must inspect all deliveries upon receipt and notify us of any damaged, short, or incorrect items within 48 hours of delivery.
5.1 We do not accept returns for change of mind.
5.2 Claims for defective, damaged, or incorrect products must be submitted in writing to enquiries@pournpack.com.au within 48 hours of delivery, with supporting photos and order details.
5.3 Where a valid claim is accepted, we will, at our discretion, replace the affected products or issue a credit note. We do not provide cash refunds.
5.4 Products must be stored in a cool, dry location and in their original packaging. We are not liable for damage resulting from improper storage.
6.1 Our products are certified home compostable ABAP 20497. Claims are based on testing conducted under the relevant Australian standard.
6.2 Composting outcomes depend on conditions outside our control. We do not guarantee any specific decomposition timeframe in your circumstances.
6.3 Product specifications, including dimensions and weight tolerances, are subject to minor variation within industry standard limits.
7.1 All content on this website, including text, images, logos, and product descriptions, is owned by or licensed to Pour & Pack and may not be reproduced without our prior written consent.
7.2 The Pour & Pack name and logo are trademarks of Pour & Pack Pty Ltd.
8.1 To the maximum extent permitted by law, our total liability to you for any claim arising out of or in connection with these Terms or any order is limited to the value of the relevant order.
8.2 We are not liable for any indirect, consequential, or special loss, including loss of revenue, loss of profit, or business interruption.
8.3 Nothing in these Terms excludes any right or guarantee you may have under the Australian Consumer Law that cannot be excluded by agreement.
We collect and handle your personal and business information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).
